These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you”) and CADTREE LIMITED (2031) (“Company,” “we,” “us,” or “our”) governing your access to and use of this website and any related media, mobile websites, or applications (collectively, the “Site”).

By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

3. Intellectual Property Rights

14. Dispute Resolution

Before initiating formal proceedings, you agree to first contact us in an effort to resolve any dispute informally.

Venue

Subject to applicable law, disputes arising from or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario.

Class Action Waiver

To the fullest extent permitted by law, disputes shall be resolved individually and not through class or collective proceedings.

The Site may contain typographical errors, inaccuracies, or omissions. We reserve the right to correct or update information at any time without prior notice.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CADTREE LIMITED (2031), ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR THESE TERMS.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE SHALL NOT EXCEED CAD $100 OR THE AMOUNT YOU PAID TO ACCESS THE SITE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

18. Indemnification

You agree to indemnify and hold harmless CADTREE LIMITED (2031), its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of:

  • Your use of the Site;

  • Your breach of these Terms; or

  • Your violation of applicable laws or third-party rights.

We may maintain data transmitted to the Site for operational and administrative purposes.

While we implement reasonable safeguards, you acknowledge that no electronic system is completely secure and we are not liable for loss or corruption of data.

20. Electronic Communications & Signatures

By visiting the Site, communicating with us electronically, or submitting forms, you consent to receive electronic communications and agree that electronic agreements and signatures satisfy legal requirements for written communications.
